Eximus Solutions Data Request Guidelines

Welcome to the home of all you need to know about our cookie policies at Eximus Solutions. We're all about keeping your privacy secure and fostering the free flow of ideas. This document outlines the hoops that government bodies, law enforcement, and folks involved in civil cases have to jump through, along with all the legal stuff, to request customer data from us.

These guidelines are just for sharing knowledge – they're not a promise from Eximus Solutions to spill the beans. We reserve the right to respond to any data request in any way that the law allows.

I. Eximus Solutions' Commitment to Privacy

We take your privacy seriously around here:

  • If it's legal, we'll let our customers know about any data requests that might involve their info.
  • We'll check the legality of each request and will challenge it if something seems off.
  • We'll only hand over the minimal amount of info required by a request.
  • We'll turn down requests that are too vague, too broad, or just too much trouble.
  • We reserve the right to say "no" to any request for any reason.
  • In emergencies where we believe it could prevent serious harm, we might share data, but we'll tell you about it if we're allowed.

II. Types of Requests

We only entertain requests that come with all the proper legal trimmings.

A. Data Request

This is when someone legally asks for info related to a customer account for some official investigation or legal tussle.

B. Preservation Request

Sometimes folks ask us to keep data on ice for an investigation. We'll usually hold onto a snapshot of the requested data for 90 days, waiting for the legal process to catch up, as long as the requester agrees to our fee schedule.

C. Emergency Request

We only look at emergency requests if they come with the right form or a valid court order, and only in life-threatening situations.

D. Expedited Requests

If you're in a rush and willing to pay extra, we might speed up your request, depending on the situation and our resources.

III. How to Make a Data Request

A. For Government Agencies or Law Enforcement

Shoot us your complete request to subpoenarequest@eximussolutions.com.

B. For Civil Matters

All civil requests need to go through the proper channels in California and follow California law.

IV. What to Include in Data Requests

Make sure to add:

  • The user's phone number or ID
  • Specific dates
  • Any other info we need to make sure we're not stepping on anyone's privacy toes.

V. What You Can Get from a Data Request

Government folks might get account info, logs, or even communication content if they've got the law on their side. Civil parties can generally only get account info or logs.

VI. Non-US Authorities

You might need an MLAT or something similar for us to share data with non-US authorities.

VII. Our Data Retention Limits

We delete data after an account is closed and can't get it back once it's gone.

VIII. Notifying Customers

We'll tell our customers about data requests unless we're legally gagged.

X. Paying for Requests:

Here's the deal on the fees we need to charge at Eximus Solutions to handle data requests. We've set these prices to cover the costs of digging up the info you need, and they apply to all requests, no matter who's asking or how they're formatted. If your request is particularly out of the ordinary or a serious hassle, we might have to add on some extra fees. These rates are all in good old U.S. dollars. Here's the breakdown:

  • Basic Info Gathering (Per Account): $50.00
  • This includes basic subscriber info, billing history, any additional numbers or extensions, and comment logs.
  • Data Preservation or Rush Jobs (Per Account): $100.00
  • If you need us to hold onto data or fast-track your request, this is the fee.
  • Call/Fax Log Records (Per Month, Per Account): $40.00
  • For keeping tabs on call and fax logs.
  • SMS Log Records (Per Month, Per Account): $40.00
  • To track SMS logs for a month.
  • Content of Communications (Per Month): $80.00
  • This covers faxes, SMS content, voice messages, and call recordings.
  • Techie Time (Per Hour for Engineering Work): $250.00
  • If we need our engineers to put in more than half an hour, we bill by the hour with a minimum of one hour.
  • Paperwork (Per Page after the first ten): $0.25
  • For photocopies and faxes, if you need more than ten pages.
  • Notarized Documents: $60.00 for travel + $10.00 per signature
  • If we have to notarize documents, this covers travel and signing.
  • Professional Hours:
  • Paralegal: $190.00/hour
  • Engineer: $250.00/hour
  • Attorney: $450.00/hour
  • Just like the engineer fee, if we spend over half an hour, we charge for a full hour.
  • For Legal Stuff (Pen Register/Trap and Trace, Intercept): Actual costs
  • Whatever it costs us, that's what we charge.

How to Pay:

By Check: Make it payable to Eximus Solutions (Tax ID # 87-3319794) and mail it to:

Don't forget to write “Subpoena Request” and your Invoice Number on the check. Oh, and bounced checks will set you back an extra $45.

ACH or Wire Transfer: Give our Accounts Payable team a ring at _________, Monday to Friday, 9:00 am to 4:00 pm Pacific Time. Have your Invoice Number handy when you call.
